Chapter I General Provisions
Article 1 In order to further strengthen the dominant position of enterprises in technological innovation, guide and support enterprises to enhance their technological innovation capabilities, improve the market-oriented mechanism for technological innovation, and standardize the management of provincial "one enterprise, one technology" R & D centers, according to the "Ten Opinions of the Shandong Provincial People's Government of the Shandong Provincial Committee of the Communist Party of China on Supporting the Healthy Development of the Non-public Economy" (Lufa [2017] No. 21) and "Several Opinions of the Shandong Provincial People's Government on Further Expanding Domestic Demand and Making up for Weaknesses and Promoting Development" (Lu Zhengfa [2018] No. 24), the "Guidelines for the Cultivation and Identification of" One Enterprise One Technology "R & D Center for Industrial Enterprises in Shandong Province" (Hereinafter).
Article 2 The "Guide" is applicable to small and medium-sized industrial enterprises (including software and information technology service enterprises) (hereinafter referred to as "enterprises") that are independent legal persons registered in the administrative area of our province.
Article 3 The positioning of the "one enterprise, one technology" R & D center is a technology R & D institution established by enterprises according to their development needs. It is an innovation platform for enterprises to make breakthroughs and master key core technologies in their industries and fields and seize the commanding heights of science and technology strategies. It is mainly responsible for carrying out technological research and development and transformation of technological achievements, industry-university-research cooperation and training of innovative talents, and promoting technological innovation of enterprises.
Article 4 Encourage and support enterprises to establish "one enterprise, one technology" R & D centers, give full play to the main role of enterprises in technological innovation, and establish and improve the system and mechanism of technological R & D and innovation in enterprises leading industries. The R & D center of "one enterprise, one technology" with strong innovation ability, good innovation mechanism, great leading and demonstration role and qualified conditions shall be identified, and the backbone enterprises of the industry shall be encouraged and guided to drive the progress of industrial technology and the improvement of innovation ability.
Article 5 The Department of Industry and Information Technology of Shandong Province is responsible for the cultivation and identification of the "one enterprise, one technology" R & D center of industrial enterprises in Shandong Province. The Municipal Bureau of Industry and Information Technology (the central department in charge of enterprises in Shandong and the province) is responsible for the recommendation and declaration of the provincial "one enterprise, one technology" R & D center.
Chapter II Identification of Provincial "One Enterprise, One Technology" R & D Center
Article 6 The identification of the provincial "one enterprise, one technology" R & D center is carried out once a year in principle. The municipal bureaus of industry and information technology (the competent departments of enterprises stationed in Shandong and the provinces) shall submit the application materials in accordance with the notice requirements of the Provincial Department of Industry and Information Technology.
Article 7 A provincial-level "one enterprise, one technology" R & D center shall meet the following basic conditions:
(I) enterprises have significant development and competitive advantages in the industry, attach importance to the development of cutting-edge technology, and have the ability to carry out high-level technological innovation activities;
In the technical field of the industry, the (II) has key core technologies or software copyrights with independent intellectual property rights, and has obtained more than 15 authorized patents in the past two years, including more than 5 invention patents; software and information technology service companies have obtained software copyrights in the past two years More than 15 items;
(III) enterprises have a better technological innovation mechanism, a sound organizational system, and significant innovation efficiency and benefits;
The (IV) has a high investment in research and development, the expenditure on technical research and development in the previous year is not less than 2 million yuan, the number of full-time research and development personnel is not less than 20, and it has technical leaders with high technical level and rich practical experience;
The (V) has relatively perfect research, development and test conditions, has fixed research and development sites, and the original value of technical development instruments and equipment is not less than 3 million yuan;
(VI) reporting enterprises are defined as small and medium-sized industrial enterprises according to national classification standards.
The (VII) has the qualification of "one enterprise, one technology" research and development center at the municipal level.
The enterprise shall not have the following circumstances within three years before the deadline for application acceptance:
(I) are subject to criminal or administrative penalties for violating the Customs Law and relevant laws and administrative regulations, which constitute smuggling, or administrative penalties for serious violations of customs supervision regulations;
(II) serious tax violations such as tax evasion and defrauding of export tax rebates due to violations of the Tax Administration Law and relevant laws and administrative regulations;
(III) other serious violations of law and breach of trust identified by judicial and administrative organs.
Article 8 The municipal bureaus of industry and information technology (the central authorities in Shandong and provincial enterprises) recommend qualified "one enterprise, one technology" research and development centers in accordance with this work guide and the notice of the year, and submit the recommended list and materials to the provincial department of industry and information technology. The application materials mainly include "one enterprise, one technology" R & D center application, evaluation form and necessary supporting materials.
Article 9 The Provincial Department of Industry and Information Technology entrusts experts to conduct audits based on the evaluation index system, and publicize the audit results to the public.
Article 10 The Provincial Department of Industry and Information Technology will issue a document within 60 working days from the date of receiving the materials to notify the municipal industry and information bureaus and relevant units of the identification results.
Chapter III Operation Evaluation
Article 11 In principle, the operation evaluation of the provincial "one enterprise, one technology" R & D center shall be organized every three years, and the evaluation notice shall be issued in the evaluation year.
All relevant enterprises shall, in accordance with the requirements of the notice, prepare self-assessment materials, mainly including the work summary, evaluation form and necessary certification materials of the provincial "one enterprise, one technology" research and development center.
The enterprise is responsible for the authenticity of the self-assessment materials and signs a letter of commitment to authenticity. The municipal bureaus of industry and information technology (the competent departments of enterprises under the central government in Shandong and the provinces) organize enterprises to carry out self-assessment work according to the requirements of the notice, and report the self-assessment materials to the Provincial Department of Industry and Information Technology.
Article 12 The Provincial Department of Industry and Information Technology organized experts to evaluate the self-assessment materials based on the evaluation index system.
Article 13 The evaluation results are divided into qualified and unqualified.
Article 14 The Provincial Department of Industry and Information Technology shall notify the municipal bureaus of industry and information technology and relevant units of the evaluation results within 60 working days from the date of accepting the self-assessment materials.
Chapter IV Encouragement Policies
Article 15 Support the "one enterprise, one technology" R & D center to undertake relevant national and provincial R & D tasks, and the municipal industry and information bureaus support the provincial "one enterprise, one technology" R & D center in accordance with their functions.
Chapter V Supervision and Administration
Article 16 The municipal bureaus of industry and information technology (the central authorities in Shandong and provincial enterprises) shall promptly report the changes such as renaming and reorganization of the enterprises where the provincial "one enterprise, one technology" research and development center is located and relevant certification materials to the Provincial Department of Industry and Information Technology. The Provincial Department of Industry and Information Technology confirms the relevant situation and publishes it regularly.
Article 17 The enterprise shall be responsible for the authenticity of the materials and data submitted by it, and the municipal industry and information bureaus (the competent departments of the central government in Shandong and provincial enterprises) shall conduct compliance examination on the enterprise application materials in accordance with the standard conditions.
Article 18 In case of any of the following circumstances, the qualification of the provincial-level "one enterprise, one technology" R & D center shall be revoked:
The (I) operation evaluation is unqualified;
(II) overdue evaluation materials;
(III) providing false materials and data;
Major quality and safety accidents (IV) occur mainly due to technical reasons;
(V) are subject to criminal or administrative penalties for violating relevant state laws and regulations;
(VI) other serious illegal and dishonest acts determined by judicial and administrative organs;
(VII) enterprises were terminated in accordance with the law.
Article 19 If the qualification of a provincial "one enterprise, one technology" R & D center is revoked for the reasons listed in items (I) to (VI) of Article 18 of this Guide, it shall not be declared again within three years from the date of revocation.
Chapter VI Supplementary Provisions
Article 20 The contents and requirements of the application materials, evaluation materials and evaluation index system involved in this guide shall be issued and timely adjusted by the Provincial Department of industry and information technology.
Article 21 According to the "the People's Republic of China Government Information Disclosure Regulations", the relevant information identified by the provincial "one enterprise, one technology" R & D center is disclosed to the public.
Article 22 This Guide is valid from April 30, 2020 to April 29, 2025.
