Notice from the Department of Science and Technology of Shandong Province on Issuing the Management Measures for Science and Technology Enterprise Incubators and Creative Spaces in Shandong Province
Chapter 1 General Provisions
Article 1: In order to implement the spirit of the "Opinions of the State Council on Promoting the High Quality Development of Innovation and Entrepreneurship and Creating an Upgraded Version of 'Double Innovation'" (Guofa [2018] No. 32) and the "Implementation Opinions of the Shandong Provincial Committee of the Communist Party of China and the Shandong Provincial People's Government on Promoting the Major Project of New and Old Kinetic Energy Conversion" (Lufa [2018] No. 9), guide the healthy and orderly development of science and technology enterprise incubators and mass creation spaces in the province, and build a good innovation and entrepreneurship ecology, this method is formulated in accordance with the spirit of the Ministry of Science and Technology's "Management Measures for Science and Technology Enterprise Incubators" (Guokefa District [2018] No. 300) and the "Interim Provisions for the Filing of National Mass Creation Spaces" (Guokehuozi [2017] No. 120), and combined with.
Article 2: Technology enterprise incubators and makerspaces (hereinafter referred to as "incubators") are technology entrepreneurship service institutions that aim to promote the transformation of achievements, cultivate technology enterprises and entrepreneurial spirit, provide physical space, shared facilities and specialized services. They are an important part of the province's technology innovation system, and an important carrier for incubating high-tech enterprises, cultivating innovative and entrepreneurial talents, and supporting mass entrepreneurship and innovation.
Article 3: The Provincial Department of Science and Technology is responsible for macro management and business guidance of incubators throughout the province, and is responsible for the recognition of provincial-level science and technology enterprise incubators and the filing management of provincial-level innovation spaces. The Municipal Science and Technology Bureau (hereinafter referred to as the "Municipal Science and Technology Bureau") is responsible for the specific services and guidance of incubators in this region.
Chapter 2 Functions and Objectives
Article 4: Incubators are divided into two categories based on their functions and positioning: technology enterprise incubators and innovation spaces.
The main function of a crowdsourcing space is to provide various innovation and entrepreneurship venues, including workspaces, online spaces, social spaces, and resource sharing spaces, for entrepreneurial teams and startups. Through market-oriented mechanisms, specialized services, and capitalization channels, it provides low-cost, convenient, multi factor, and open innovation and entrepreneurship incubation services.
The main function of a technology enterprise incubator is to gather various resource elements around the growth needs of technology enterprises, promote technology-based innovation and entrepreneurship, provide entrepreneurial venues, shared facilities, technical services, consulting services, investment and financing, entrepreneurial counseling, resource docking and other services, promote enterprise growth, drive employment through entrepreneurship, and stimulate the vitality of innovation and entrepreneurship in the whole society.
Article 5: Incubators should innovate their institutional mechanisms, actively learn from new models such as the sharing economy, integrate social resources, continuously improve the level of service for incubation teams and enterprises, fully meet the personalized needs of entrepreneurial teams and enterprises in terms of space, management, service, cooperation, etc., reduce innovation costs, assist in entrepreneurial success, form an effective development model of "mass entrepreneurship space technology enterprise incubator accelerator technology park", and create a good innovation and entrepreneurship ecosystem.
Chapter 3 Filing or Recognition Conditions
第六条 省级众创空间实行备案管理。申请备案省级众创空间，应具备以下条件：
1.设立专门运营管理机构，具有山东省内注册独立法人资格，成立并实际运营一年以上；
2.拥有不低于300平方米的服务场地，或提供创业工位不少于20个。同时具有能够为创业者使用的公共接待、项目展示、会议洽谈、专业设备等公共服务场地。提供创业工位和公共服务场地面积不低于众创空间总面积的75%；
3.入驻创业团队或企业总数不低于15家，且入驻创业团队每年注册成为新企业数不低于5家；
4.具有专职运营服务团队，具备一定的创新创业经验和专业服务能力；
5.具有完善的运营工作机制，包括项目遴选、毕业或淘汰机制、财务管理和创业导师工作机制等。
第七条 省级科技企业孵化器实行认定管理。申请认定省级科技企业孵化器，应具备以下条件：
1. 设立专门运营管理机构，具有山东省内注册独立法人资格，明确发展方向，完善的运营管理体系和孵化服务机制。机构实际注册并运营满3年，且至少连续2年报送真实完整的统计数据；
2. 孵化场地集中，孵化场地面积不低于5000平方米。其中，在孵企业使用面积（含公共服务面积）占75%以上；
3. 配备自有种子资金或合作的孵化资金，且资金规模不低于300万元人民币；有获得投融资的在孵企业，并能提供资金使用案例；
4. 拥有职业化的服务队伍，专业孵化服务人员（指具有创业、投融资、企业管理等经验或经过创业服务相关培训的孵化器专职工作人员）占机构总人数80%以上，每10家在孵企业至少配备1名专业孵化服务人员和1名创业导师（指接受科技部门、行业协会或孵化器聘任，能对创业企业、创业者提供专业化实践辅导服务的企业家、投资专家、管理咨询专家）；
5. 科技企业孵化器在孵企业中已申请专利等知识产权的企业占在孵企业总数比例不低于40%或拥有有效知识产权的企业占比不低于20%；
6. 科技企业孵化器在孵企业不少于30家且每千平方米平均在孵企业数原则上不少于3家；已入驻国家科技型中小企业库备案的企业占在孵企业40%以上；
7. 科技企业孵化器累计毕业达到10家以上。
第八条 本办法所称科技企业孵化器在孵企业应具备以下条件：
1.主要从事新技术、新产品研发、生产和服务；
2.企业注册地和主要研发、办公场所须在本孵化器场地内，入驻时成立时间不超过36个月；
3.孵化时限原则上不超过48个月。技术领域为生物医药、现代农业、集成电路的企业，孵化时限不超过60个月。
第九条 企业从科技企业孵化器中毕业应至少符合以下条件中的一项：
1.经国家认定通过的高新技术企业；
2.有2年以上的运营期，经营状况良好，累计获得天使投资、风险投资、银行贷款、股票筹资、债权融资等超过100万元；
3.连续2年营业收入累计超过1000万元；
4.被兼并、收购或在国内外资本市场挂牌、上市。
第十条西部经济隆起带所在县（区）和省财政直管县的科技企业孵化器，孵化场地面积、在孵和毕业企业数量、孵化资金规模、知识产权比例等要求可降低20%。
第四章 备案或认定流程
第十一条 省级众创空间备案程序为：
1.申报机构通过省科技云平台管理系统填报信息，向市科技局提出备案申请。
2.市科技局审核备案申请,并进行现场考核，对符合备案条件的进行公示，公示期5个工作日。
3. 公示无异议后由市科技局向省科技厅行文，省科技厅予以备案。
第十二条 省级科技企业孵化器认定程序为：
1.申报机构通过省科技云平台管理系统填报信息，向市科技局提出认定申请。
2.市科技局审核认定申请，对符合认定条件的推荐至省科技厅。
3.省科技厅对推荐申请进行审核，并进行现场考核，对符合条件的进行公示，公示期为5个工作日。
4. 公示无异议后省科技厅予以认定。
第五章 运行与管理
第十三条 众创空间应加强和完善服务保障能力，为创业团队和初创企业提供创新创业前期的多方位服务。
1.组建创业导师队伍，在技术研发、商业模式构建、经营管理、资本运作、市场营销等方面为创业团队提供实践性辅导和培训，为在孵企业提供精准化、高质量的创业服务。
2.建立知识产权专业服务机构或分支机构，为在孵创业团队提供专利、商标、版权等知识产权代理、导航、维权、规划及咨询等方面的一站式综合服务。
3.积极吸纳大学生创新创业，建立实习基地，开展创新创业辅导等专业化服务。
第十四条科技企业孵化器应强化专业化科技服务体系建设，为在孵企业提供高质量、高标准、全方位的服务。
1.强化专业化服务团队建设，加强对双创扶持政策的宣传培训，帮助在孵企业全面了解、准确把握、充分运用创新创业政策。
2.建立或引入知识产权服务、法律服务、财务服务、政策咨询服务、技术转移服务和金融服务等专业机构，为入驻的企业和团队提供个性化精准定制的创业服务。
3. 为在孵企业建立公共研发技术平台、建设专业化中试基地，提高资源集聚度，加快在孵企业的科技成果向现实生产力转化。
4. 积极组织与金融机构开展交流对接活动，协调引进或联合社会力量共同设立天使投资基金等投资基金，完善孵化器金融服务体系，提高投融资服务能力。
5.积极融入全球创新创业网络，开展国际技术转移、离岸孵化等业务，引进海外优质项目、技术成果和人才等资源，帮助创业者对接海外市场。
第十五条 省科技厅组织开展孵化器绩效评价工作，每三年为一个周期，分批次对孵化器进行绩效评价，重点评价孵化器管理服务情况、科技型企业和创业团队培育成效等内容。评价结果分为优秀、良好、合格和不合格四个等级。对绩效评价结果为优秀的科技企业孵化器和众创空间分别给予奖励，优先推荐申报认定国家级科技企业孵化器和备案国家众创空间。评价结果为不合格的限期整改，整改期为一年。整改期满仍未达到合格标准的，取消其备案或认定资格，3年内不再受理省级孵化器备案或认定申请。
第十六条孵化器发生名称变更或运营管理机构、面积范围、场地位置等备案或认定条件发生变化的，需在2个月内向所在市科技局报告。市科技局审核并实地审查后，符合本办法要求的，向省科技厅提出变更建议；不符合本办法要求的，向省科技厅提出取消资格建议。
第十七条 经备案或认定的孵化器应按照要求如实填报年报数据，年报数据将作为绩效评估的重要参考依据。
第十八条 在申报过程中存在弄虚作假行为的，取消其省级孵化器评审资格，3年内不得再次申报；在填报年报过程中存在弄虚作假行为的或连续2年未报送真实完整的统计数据，取消其省级孵化器资格，3年内不得再次申报。
第十九条 各级地方政府和科技行政主管部门应认真落实国家关于孵化器的各项扶持政策，在孵化器发展规划、用地、财政、科技创新等方面制定相应的扶持政策，加强对孵化器的动态监督管理，不断提升孵化器管理服务水平。
Chapter 6 Supplementary Provisions
第二十条 本办法由省科技厅负责解释。
第二十一条本办法自2019年8月9日起实施，有效期至2022年8月9日。
