Article 40: The relevant competent departments of the municipal government shall conduct dynamic evaluations of the road testing and demonstration of intelligent connected vehicles, and report the situation of intelligent connected vehicle road testing and demonstration within their jurisdiction to the relevant competent departments of the provincial government every six months.
Chapter 8 Traffic Violations and Accident Handling
Article 41: If road testing and demonstration vehicles commit road traffic safety violations, the traffic management department of the public security organs shall handle them in accordance with the relevant provisions of road traffic safety management such as the Road Traffic Safety Law of the People's Republic of China and its implementing regulations; In the event of a traffic accident, the traffic management department of the public security organ shall handle it in accordance with road traffic safety laws, regulations and relevant provisions, and determine the responsibility for the traffic accident in accordance with relevant laws, regulations and judicial interpretations; The traffic management department of the public security organs shall impose penalties on the parties involved for road traffic safety violations in accordance with the law; If a crime is committed, the parties involved shall be held criminally responsible in accordance with the law.
Article 42: In the event of a traffic accident or loss of control during road testing or demonstration applications or demonstration operations, the road testing and demonstration subject or its safety officer shall immediately stop the road testing or demonstration related work, protect the scene, immediately report to the police, initiate emergency response procedures, and cooperate with the traffic management department of the public security organs to complete traffic accident investigation and evidence collection, responsibility determination, and other matters.
The road testing and demonstration subject shall report the vehicle status data before and after the accident or incident for at least 90 seconds to the relevant municipal government departments and third-party management agencies within 24 hours.
If a road traffic accident occurs, the road testing and demonstration subject shall report the accident situation to the relevant competent department of the municipal government and the third-party management agency within 24 hours. Those who fail to report as required may have their road testing and demonstration suspended for 24 months. If it causes serious injury or death to personnel or damage to vehicles, the relevant competent department of the municipal government shall report to the relevant competent department of the provincial government within 24 hours.
Public security traffic management department docking report accident all input system.
Article 43 the subject of road test and demonstration shall, within 3 working days after the accident is identified, report in writing the relevant materials such as the cause of the accident, the result of responsibility determination and the complete accident analysis report to the relevant competent departments of the municipal government and the third-party management institutions; the relevant competent departments of the municipal government shall report to the relevant competent departments of the provincial government within 3 working days. In the event of a traffic accident or safety incident, the relevant competent departments of the municipal government may suspend the test and demonstration activities of the relevant road test and demonstration subjects, and after research and evaluation, resume or terminate the relevant road test and demonstration activities according to the determination of accident responsibility.
Chapter IX Supplementary Provisions
Article 44 The terms listed in these Measures shall have the following meanings:
(I) intelligent connected vehicle refers to equipped with advanced on-board sensors, controllers, actuators and other devices, and integrates modern communication and network technologies to realize intelligent information exchange and sharing between the vehicle and X (people, vehicles, roads, clouds, etc.). Complex environmental perception, intelligent decision-making, collaborative control and other functions can realize safe, efficient, comfortable and energy-saving driving, and eventually a new generation of cars that replace people to operate. Smart connected cars are also commonly referred to as smart cars, self-driving cars, etc.
(II) intelligent network car automatic driving includes conditional automatic driving, highly automatic driving and fully automatic driving. Conditional automatic driving refers to the completion of all dynamic driving tasks under the designed operating conditions of the system, and the driver shall provide appropriate intervention according to the system dynamic driving task takeover request; highly automatic driving refers to the completion of all dynamic driving tasks under the designed operating conditions of the system, and the system will make a dynamic driving task takeover request to the driver under specific circumstances, and the driver/passenger may not respond to the system request; fully autonomous driving means that the system can complete dynamic driving tasks in all road environments that the driver can complete, without the need for driver/passenger intervention.
(III) Design Operating Conditions (Operational Design Condition,ODC) is the general term for the various conditions applicable to the operation of the driving automation system, including the design operating range, vehicle status and driver status. Among them, the design operation range (Operational Design Domain,ODD) is the external environmental conditions suitable for the functional operation of the driving automation system determined during the design, generally including: 1. Road boundary and road surface state; 2. Traffic infrastructure; 3. Temporary road changes; 4. Status of other traffic participants; 5. Natural environment; 6. Conditions such as network communication and digital map support.
(IV) carrying personnel refer to natural persons who have full capacity for civil conduct or have guardian's accompanying protection and do not have full capacity for civil conduct, and fully understand the content, scope and risks of the demonstration application and operation of intelligent network-connected vehicles, voluntarily participate in the demonstration application and operation and have signed relevant agreements. Minors can participate in the demonstration application and operation experience under the escort of the guardian.
Article 45 These Measures shall be interpreted by the Department of Industry and Information Technology of Shandong Province, the Department of Public Security of Shandong Province, and the Department of Transportation of Shandong Province. They shall come into force on February 1, 2026 and shall be valid until December 31, 2028.
