Shandong Equipment Manufacturing Industry Association Industry Dispute Resolution Rules

Article 1: In order to correctly and timely handle disputes within the industry and protect the legitimate rights and interests of member units of Shandong Equipment Manufacturing Association, these rules are formulated.

Article 2: These rules apply to the resolution of disputes between member units of Shandong Equipment Manufacturing Association or between member units and non member units.

Article 3: Disputes among member units of the Shandong Equipment Manufacturing Industry Association shall be mediated or adjudicated based on facts and guided by law. The parties involved have equal status in the handling process.

Article 4: The Shandong Equipment Manufacturing Industry Association accepts disputes arising from the performance of industry conventions within the industry.

Article 5: If the party in dispute within the industry is a non member unit, the Shandong Equipment Manufacturing Industry Association shall invite relevant departments to participate in the handling of the dispute after accepting it.

Article 6: Dispute Resolution Procedures within the Industry:

（1） When disputes arise between member units, the disputing parties should strive to resolve them through negotiation based on the principle of mutual understanding and compromise.

（2） When negotiation fails, both parties or one party may request mediation from the Shandong Equipment Manufacturing Industry Association, arbitration institutions, judicial institutions, etc.

（3） When mediation fails, both parties or one party may also file a lawsuit with the people's court in accordance with the law.

Article 7: Measures for Handling Industry Violations and Breaches:

（1） If a member unit violates industry regulations and professional ethics, any unit or individual has the right to report to the Shandong Equipment Manufacturing Industry Association.

（2） The Shandong Equipment Manufacturing Industry Association shall promptly organize investigations and propose the following handling opinions based on the nature of any violations or breaches of contract by member units:

1. Critical education;

2. Organize and coordinate reconciliation between both parties;

3. Internal industry notifications;

4. Public announcement;

5. Cancel membership;

6. Suggest relevant departments to impose penalties.

This measure was discussed and approved by the second council meeting on July 28, 2018.
