How can social organizations carry out the construction of the rule of law? This is the answer to the 19th Shandong Provincial Social Organization Lecture Hall
On the afternoon of October 27th, the 19th session of the Shandong Social Organization Lecture Hall, hosted by the Provincial Federation of Social Organizations, the Provincial Advertising Association, and Shandong Huanzhou Haocai Law Firm, opened brilliantly in the conference room on the 8th floor of the Qinglian Building. Bi Xiaohong, Chairman of the Legal Special Committee of the General Association and Partner of Shandong Huanzhou Haocai Law Firm, gave a wonderful lecture on the topic of "Social Organizations for the Construction of a Rule of Law Society", attracting nearly 100 leaders of social organizations to attend.
Bi Xiaohong elaborates on the legal construction of social organizations from seven aspects: the development process of social organizations and their norms, the problems and challenges they face, innovation and development directions, composition, basic rights and obligations, legal persons, and non-profit legal persons. She said that social organizations have clear goals, standardized systems, and formal status. They are the scanners of people's livelihood needs, the deliverers of public services, the speakers of appeals, and the moderators of public conflicts. They have gone through three stages: sprouting, starting, and developing. At present, social organizations are facing challenges such as funding, management, trust, and policy issues. They need to strengthen their own construction by "establishing awareness, building structures, strengthening cooperation, and establishing rules". At the same time, they should pay attention to diversity and inclusiveness, constantly innovate, actively participate in social governance, and realize their own value. Social organizations include three types: social groups, foundations, and social service agencies, all of which enjoy rights such as name, reputation, honor, information, guardianship, and property rights. Social organizations have the general characteristics of legal persons and should be established in accordance with the law, with corresponding names, organizational structures, residences, assets, and funds. Their registration changes, mergers and divisions, termination, dissolution, and liquidation must comply with relevant legal provisions and follow corresponding procedures. China has fully incorporated social organizations into the non-profit legal entity category in the form of a legal code. Non profit legal entities are legal entities established for public welfare or other non-profit purposes, and do not distribute profits obtained to investors, founders, or members. Various social organizations should firmly grasp the fundamental premise of "non-profit legal entities", and be cautious and strictly controlled in all aspects of establishment, registration management, articles of association, organizational structure, property management, and supervision, to block legal risks that may arise during the operation of social organizations. Combating illegal social organizations is an important part of social organizations' safeguarding their legitimate rights and interests and improving their credibility. You can identify the legitimacy of social organizations through the China Social Organization Network and China Social Organization Dynamic official account to prevent them from being used by illegal social organizations or pyramid selling organizations and causing unnecessary economic losses. After entering the interactive stage, Bi Xiaohong focused on answering questions from several social organization leaders, discussing topics of common concern such as the existence of labor contracts, whether profit distribution can be carried out, and how to make public welfare donations.
The head of the association summarized that he gained a lot from this lecture on the construction of the rule of law, such as "non-profit legal persons and non legal person organizations for public welfare purposes shall not act as guarantors". He said that the construction of the rule of law in social organizations covers various aspects such as legal person types, property attributes, internal governance, activity guidelines, and role play. It is not only a weapon for every social organization to protect its own rights and interests, but also a basic norm that must be followed. Everyone should strengthen their awareness of complying with the law, abiding by the law, and using the law, and form a mechanism for handling affairs in accordance with the law, seeking the law when encountering problems, using the law to solve problems, and relying on the law to resolve conflicts. I hope that in the future, everyone will actively provide suggestions and recommendations for the lecture hall, propose the required topics, apply for the content of the lecture, gather the strength of everyone, and build the lecture hall into a brand of social organizations in Shandong Province, and help promote the high-quality development of social organizations in our province.
