Establishing a sound mechanism for entrepreneurs to participate in the formulation of enterprise related policies in China
On the 17th, the National Development and Reform Commission stated that China has put forward institutional and normative requirements for entrepreneurs to participate in the formulation of policies related to enterprises.
With the approval of the State Council, the National Development and Reform Commission recently issued the Implementation Opinions on Establishing and Improving the Mechanism for Entrepreneurs to Participate in Enterprise related Policy Making. Clear opinions are needed to establish procedural norms for the government to actively seek advice and strategies from entrepreneurs in major economic decisions, to brainstorm and promote democracy, to encourage entrepreneurs to actively participate in the formulation of policies related to enterprises, to mobilize the enthusiasm, initiative, and creativity of entrepreneurs, to better play the role of entrepreneurs, to strengthen their confidence, stabilize their expectations, and promote sustainable and healthy economic development.
The opinion clarifies the normative requirements for classifying and listening to opinions and suggestions, and points out that the drafting department should fully listen to the opinions and suggestions of entrepreneurs when researching and formulating special policies that have a significant impact on the vital interests or rights and obligations of enterprises and affect their production and operation; When researching and formulating major strategies, plans, reforms, policies, and projects for economic and social development, except for legally required confidentiality and important sensitive matters, the leading department should listen to the opinions and suggestions of entrepreneurs through appropriate forms and within a certain scope.
The opinions also put forward the main tasks of fully listening to the opinions and suggestions of entrepreneurs on policies related to enterprises, smoothing the channels for entrepreneurs to express their opinions and demands, improving the mechanism for handling and feedback of entrepreneurs' opinions, and perfecting the publicity, interpretation, and execution supervision of policies related to enterprises.
Clear opinions and sound procedures for evaluating and adjusting policies related to enterprises. After the implementation of policies related to enterprises, timely evaluations of policy implementation led by third-party organizations and involving representatives of entrepreneurs should be conducted. For policies related to enterprises that require adjustment, opinions and suggestions from entrepreneurs and relevant parties should be listened to, and adjustments should be made according to procedures. For policy adjustments that may increase enterprise costs and affect normal production and operation, a reasonable buffer period should be set based on listening to the opinions of relevant industry enterprises. For enterprises whose legitimate rights and interests are damaged due to policy adjustments, compensation shall be provided in accordance with the law and regulations.
The opinion emphasizes the need to strengthen regular communication and contact between the government and entrepreneurs, and local governments at all levels should enhance daily communication and contact with local entrepreneurs to help enterprises solve practical difficulties and problems.
