Overall Plan for China (Shandong) Pilot Free Trade Zone
The establishment of the China (Shandong) Pilot Free Trade Zone (hereinafter referred to as the Pilot Free Trade Zone) is a major decision made by the Party Central Committee and the State Council, and is a strategic measure to promote reform and opening up in the new era. This program is formulated for the construction of a high-standard and high-quality pilot free trade zone.
1、 Overall requirements
(I) guiding ideology. Guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, fully implement the spirit of the 19th National Congress of the Communist Party of China and the Second and Third Plenary Sessions of the 19th Central Committee, coordinate the promotion of the "five in one" overall layout and coordinate the promotion of the "four comprehensive" strategic layout. Adhere to the general tone of the work of seeking progress while maintaining stability, adhere to the new development concept, adhere to high-quality development, take the supply-side structural reforms as the main line, and actively serve and integrate, better serve the overall strategic layout of opening up, emancipate the mind, boldly innovate, and build the pilot free trade zone into a new highland for reform and opening up in the new era.
(II) strategic positioning and development goals. With institutional innovation as the core and replicable and popularized as the basic requirements, we will fully implement the requirements of the central authorities on enhancing the innovation of economic and social development, changing the mode of economic development, and building a maritime power. we will speed up the continuous transformation of new and old development momentum, develop the marine economy, and form a new highland for opening up to the outside world. After three to five years of reform and exploration, we will benchmark international advanced rules, form more internationally competitive institutional innovations, promote changes in the quality, efficiency, and power of economic development, and strive to build a convenient trade and investment, perfect financial services, and safe supervision. A high-standard and high-quality free trade park with high efficiency and outstanding radiation-driven effects.
2. location layout
(I) the scope of implementation. The implementation area of the pilot free trade zone is 119.98 square kilometers, covering three areas: 37.99 square kilometers in Jinan area, 52 square kilometers in Qingdao area (including 9.12 square kilometers in Qingdao Qianwan bonded Port area and 2.01 square kilometers in Qingdao West Coast Comprehensive bonded Zone). Yantai area 29.99 square kilometers (including 2.26 square kilometers in Yantai bonded Port area).
The development and utilization of land in the pilot free trade zone must comply with the laws and regulations on land use, ecological environment protection, and urban and rural planning, in line with the overall land use planning and urban and rural planning, and in line with the relevant requirements of economical and intensive land use; if the ocean is involved, it must comply with the relevant provisions of laws and regulations such as the the People's Republic of China Sea Area Use Management Law and the the People's Republic of China Marine Environmental Protection Law.
(II) functional division. Jinan area focuses on the development of artificial intelligence, industrial finance, medical and health care, cultural industry, information technology and other industries, carries out comprehensive pilot experiments on the new open economic system, and builds an important regional economic center, logistics center and scientific and technological innovation center in China; Qingdao area focuses on the development of modern ocean, international trade, shipping logistics, modern finance, advanced manufacturing and other industries, build an international shipping hub in Northeast Asia, an important innovation center in the eastern coast, and a marine economic development demonstration zone to help Qingdao build an important coastal central city in my country; the Yantai area focuses on the development of high-end equipment manufacturing, new materials, new generation information technology, energy conservation and environmental protection, and biomedicine And producer services, to create a pilot zone for China-South Korea trade and investment cooperation, a marine intelligent manufacturing base, a national scientific and technological achievements and international technology transfer demonstration zone.
3. main tasks and measures
(I) accelerate the transformation of government functions.
1. Create a world-class business environment. Deepen the reform of the commercial system and promote the full coverage of the reform of "separation of licenses and licenses. The economic and social management authority that Shandong Province can delegate is all delegated to the pilot free trade zone. We will carry out "minimal examination and approval" and "no-meeting examination and approval (service)" and deepen the reform of "doing a good job at one time. Reform of the examination and approval system for construction projects will be carried out in an all-round way. Apply artificial intelligence technology to improve the level of social governance. Establish and improve the post-event supervision system with credit supervision as the core and in line with the negative list management mode. Strengthen the fundamental position of competition policy. Cooperate with foreign investment security review.
(II) deepen reform in the investment sector.
2. Deeply promote investment liberalization and facilitation. Fully implement the pre-entry national treatment plus negative list management system for foreign investment. Explore the establishment of a foreign investment information reporting system. Support foreign-invested enterprises to participate in the formulation of hydrogen energy vehicle standards. Support the establishment of wholly foreign-owned business education training and vocational skills training institutions. Support foreign investment in the establishment of air transport sales agency enterprises. Unify the qualification requirements for investors of domestic and foreign talent intermediaries, which shall be examined and approved by the administrative agency of the pilot free trade zone and reported to the provincial human resources and social security department for the record. Qualified foreign travel agencies registered in the Pilot Free Trade Zone are allowed to engage in outbound tourism business other than Taiwan.
3. Improve investment promotion and protection mechanisms. We will establish and improve the service system for foreign investment, and improve the working mechanism for foreign investment promotion, project tracking services and complaints. The Pilot Free Trade Zone is encouraged to formulate foreign investment promotion policies within its statutory authority. Pilot construction of a two-way investment promotion public service platform for small and medium-sized enterprises. Improve the comprehensive service system of "going out" of enterprises. Support "going out" enterprises to obtain loans with overseas assets and equity, mining rights and other interests as collateral.
(III) promote trade transformation and upgrading.
4. Improve the level of trade facilitation. Explore the international mutual recognition mechanism of inspection and quarantine and traceability standards for food and agricultural products, and expand the scope of third-party inspection results to accept commodities and institutions. Innovative export goods patent dispute guarantee release method. Vigorously develop transit trade. Focus on the development of domestic and foreign goods transit, pooling and international distribution and distribution business. Comprehensive implementation of classified supervision of the status of goods in special customs supervision areas. For financial leasing enterprises registered in the special customs supervision area of the pilot free trade zone, the import and export of aircraft, ships, marine engineering structures and other large-scale equipment involving cross-customs areas, on the premise of ensuring effective supervision and implementation of the current tax policy, the customs shall be entrusted to supervise in different places. Explore the cancellation of business licenses for enterprises engaged in trade brokerage and agency in the special customs supervision area of the Pilot Free Trade Zone or change to filing, unless otherwise provided by laws and regulations. The customs will provide customs clearance convenience for the import, processing and re-export of high value-added CNC machine tools, engineering equipment, electronic equipment, communication equipment and other old mechanical and electrical equipment that meet the national environmental protection requirements. Support the establishment of comprehensive bonded areas in eligible areas of the Pilot Free Trade Zone.
5. Cultivate new trade formats and new models. Support enterprises in the pilot free trade zone to carry out cross-border e-commerce import and export business, and gradually realize the comprehensive bonded zone in the pilot free trade zone to fully apply the cross-border e-commerce retail import policy in accordance with the law. Under the premise of risk control and in accordance with laws and regulations, actively carry out aircraft parts recycling and remanufacturing. Support the construction of automobile import ports in the Pilot Free Trade Zone. Support the Qingdao area to increase the number of pilot enterprises for parallel import of automobiles in a timely manner. Accelerate the development of digital trade. Promote the storage and display of cultural relics and cultural works of art in the comprehensive bonded area of the pilot free trade zone.
6. Continuously optimize the trade structure. According to the reform process of the oil and gas system and the needs of the industry, we will study and give qualified enterprises in the pilot free trade zone to import crude oil. Registered enterprises in the FTZ are allowed to carry out the blending of bonded oil products under different tax numbers. Support qualified ship oil supply enterprises to carry out bonded oil supply business for international navigation ships. Support relying on existing trading venues to carry out cotton and other commodities trading in accordance with the law. Support the establishment of designated supervision sites for the import of food and agricultural products, and build import and export distribution centers for food and agricultural products and wine. Bonded supervision shall be carried out for qualified enterprises outside the special customs supervision area to carry out high value-added, high-tech content, and "two-end" inspection, maintenance and remanufacturing formats that meet environmental protection requirements.
(IV) deepen open innovation in the financial sector.
7. Expand the cross-border use of RMB. Explore the return mode of export trade under RMB capital, and focus on promoting the cross-border use of RMB in the field of trade and investment. Support qualified multinational companies to carry out cross-border RMB fund pool business in accordance with regulations. Support banks in the Pilot Free Trade Zone to issue overseas RMB loans in accordance with regulations. Explore the use of RMB-denominated settlement by financial institutions in the Pilot Free Trade Zone when conducting cross-border asset transfers and other businesses in accordance with regulations, and incorporate full-caliber macro-prudential management of cross-border financing.
8. Facilitate cross-border investment and financing. Pilot reform of capital project revenue payment facilitation. The income from trade in goods of enterprises classified as Class A in the foreign exchange management of trade in goods in the FTZ can be directly transferred to the current account settlement account. Study and carry out the pilot work of qualified domestic limited partners (QDLP). Support the establishment of foreign-invested financial institutions in the Pilot Free Trade Zone in accordance with the law. Explore the establishment of a professional domestic equity investment fund company. Support foreign equity investment management institutions and foreign venture capital management institutions to initiate and manage RMB equity investment and venture capital funds in the Pilot Free Trade Zone.
9. Explore the implementation of financial innovation. Under the premise of strict supervision, the pilot of comprehensive financial operation shall be carried out in a prudent and orderly manner. Support local corporate banks to carry out pilot stock-bond linkage business. Explore the development of private equity investment secondary trading funds. Encourage innovation in intellectual property insurance business and carry out special reform and innovation in fund management services. Support the insurance legal person institutions in the FTZ to carry out overseas investment in accordance with the law. Support qualified financial leasing companies to set up professional subsidiaries in the pilot free trade zone. According to the needs of futures bonded delivery business, it is allowed to expand the function of warehouse receipt pledge financing, and promote the improvement of warehouse receipt pledge financing involved in warehouse receipt confirmation and other work. Strengthen the identification of major risks and the prevention of systemic financial risks. Strengthen anti-money laundering, anti-terrorist financing, anti-tax evasion work.
(V) promote innovation-driven development.
10. Strengthen innovation capacity building. Support the construction of innovation platforms such as overseas innovation incubation centers and offshore innovation and entrepreneurship bases for overseas talents. Support enterprises in joint financial institutions, universities and research institutes to build industrial innovation platforms. Support the construction of Shandong Industrial Technology Research Institute. Encourage famous foreign universities to come to China to carry out cooperation in running schools. Promote the development of dual-system vocational education and set up an intelligent manufacturing technician college. Support the Qingdao area to carry out high-level Sino-German cooperation in running schools.
11. Promote the development of the medical and pharmaceutical industry. Under the framework of relevant institutional arrangements, Hong Kong and Macao service providers are allowed to set up wholly-owned medical institutions in accordance with the provisions. Support the development of plastic surgery, advanced medical technology research and development and incubation. Medical institutions in the Pilot Free Trade Zone may carry out research on stem cell clinical frontier medical technology in accordance with relevant regulations. Accelerate the approval of innovative drugs on the market, anti-cancer drugs, rare disease drugs and other clinical urgent need for innovative drugs to implement priority review and approval. Optimize the quarantine inspection process for special items for biopharmaceutical global collaborative research and development testing. To carry out the pilot system of medical device registrants, allowing medical device registrants in the free trade test zone to entrust medical device manufacturers in Shandong Province to produce products. Allows the introduction and creation of international medical organizations, hosting international medical conferences. Giving priority access to medical personnel and advanced medical technology. Encourage qualified personnel to provide traditional Chinese medicine treatment services in medical institutions, and the promotion of professional titles of full-time doctors in medical institutions.
12. Improve the system for the protection and use of intellectual property rights. The establishment of intellectual property dispute settlement and rapid rights protection mechanism. Support the establishment of an intellectual property operations center. Improve the intellectual property assessment mechanism, the pledge financing risk-sharing mechanism and the convenient and efficient material disposal mechanism. Explore the talent and technology capitalization evaluation mechanism, to achieve intellectual property rights can be valued, the results can be valued, the talent team has a value. Relaxation of conditions for shareholders and partners of patent agencies.
13. Optimize the environment for the development of foreign and Hong Kong, Macao and Taiwan talents. Support Hong Kong, Macao and Taiwan professionals and qualified foreign professionals to work in the pilot free trade zone. Further provide entry and exit facilities for foreigners from the pilot trade zone to carry out business, tourism and other activities. To carry out foreign high-end talent service "card" pilot. In international conferences, foreign invitations, envoys visits and other matters that need to be reviewed and approved, a through train system for foreign affairs review and approval will be established.
(VI) high-quality development of the marine economy.
14. Accelerate the development of industries with marine characteristics. Construction of Northeast Asia aquatic products processing and trade center. Promote the construction of marine engineering equipment research institutes and major research and development, test and verification platforms and smart terminals, and develop marine equipment research and development, manufacturing, maintenance, and service industries. Support the exploration and construction of modern marine seed industry resources introduction transfer base, speed up the quarantine access of high-quality aquatic fry. Optimize the licensing procedures for the import of marine germplasm and its biological products, and strengthen the research and industrial application of marine germplasm and genetic resources. Promote the construction of the national marine drug pilot base and the blue drug library research and development and production base, and include marine drugs in the national medical insurance catalog as required. Support qualified financial institutions in the Pilot Free Trade Zone to provide various sea-related financial services.
15. Enhance the level of international cooperation on oceans and seas. Give full play to the role of the East Asian maritime cooperation platform, regional and external linkages, and deepen open cooperation. Support sea-related universities, scientific research institutes, national laboratories, enterprises and domestic and foreign institutions to jointly build marine laboratories and marine research centers. Support the establishment of branches of international maritime organizations in Shandong Province. Build the International Marine Genomics Consortium to provide global marine biological gene sequencing services. Support sea-related enterprises to participate in the formulation of international standards.
16. Enhance the capacity of shipping services. Build a comprehensive information platform for shipping big data. Explore the use of existing trading venues to carry out shipping elements such as ships in accordance with the law. Support the Qingdao International Marine Property Rights Trading Center to carry out international ship trading on a pilot basis. Support the establishment of a multi-functional warehouse for international transit goods. Gradually open up the classification of Chinese international navigation ships. Support the development of foreign cruise ship maintenance business. Give full play to the advantages of port functions, establish a multimodal transport service system with the "one-order system" as the core, improve the China-Europe train operation platform in Shandong Province, and build a large east-west interconnection channel connecting Japan and South Korea in the east and Eurasia in the west. We will strengthen the linkage between the pilot free trade zone and seaports and airports, and promote the coordinated development of land, sea and air mail.
(VII) deepen regional economic cooperation between China, Japan and South Korea.
17. Explore local economic cooperation among the three countries. Strengthen complementary advantages and explore joint development of third-party markets. High standard construction of China and South Korea (Yantai) industrial park, innovation "two countries double park" cooperation mode. Support cooperation in the construction of medical care and health centers. Promote the establishment of an international platform for the transfer and transformation of scientific and technological achievements. Support the development of RMB overseas fund business in accordance with regulations. Foreign exchanges are allowed to set up offices in the Pilot Free Trade Zone.
18. Promote regional cooperation and exchange facilitation. We will strengthen cooperation in the mutual recognition of "certified operators (AEO)" between the customs of China, Japan and China and South Korea, and build an efficient and smooth cooperation mechanism in information exchange, mutual recognition of supervision, mutual assistance in law enforcement, inspection and quarantine, and standard measurement. Cooperate with Japan and South Korea to determine the list of fresh agricultural and sideline products and speed up the opening of a green channel for rapid customs clearance. Innovating the regulatory model of "telecommunication declaration and epidemic-free passage" for liner health and quarantine between free trade agreement parties.
4. guarantee mechanism
Adhere to and strengthen the party's leadership over reform and opening up, and put the party's leadership throughout the whole process of the construction of the free trade pilot zone. Strengthen bottom-line thinking and risk awareness, improve risk prevention and control and disposal mechanisms, achieve stable, safe and efficient regional operation, and effectively safeguard national security and social security. Under the overall planning and coordination of the inter-ministerial joint meeting on the work of the pilot free trade zone of the State Council, we will give full play to the enthusiasm of localities and departments, do a good job in the implementation of various reform pilot tasks, and build a pilot free trade zone with high standards and high quality. Shandong Province must improve the working mechanism, build a streamlined, efficient, and clear management system for the pilot free trade zone, strengthen talent training, and build a high-quality management team; it must strengthen local legislation and establish a fair, transparent, and systematic legal environment. All areas of the pilot free trade zone should do their work in detail, implement the system, strictly supervise, and strictly enforce discipline and law enforcement. All relevant departments should delegate relevant management authority in a timely manner and give full reform autonomy. The reform policies and measures proposed in this plan shall be handled in accordance with the prescribed procedures if they involve the adjustment of existing laws or administrative regulations.
