Chapter 1 General Provisions

Article 1 in order to implement the requirements of the Circular of the General Office of the people's Government of Shandong Province on printing and distributing policies to support the development of Heze City and other four cities in western Shandong Province (No. 13, 2019), promote the transformation of scientific and technological achievements in Heze City, support the innovation and development of Heze City, and strengthen and standardize the use and management of technology transfer subsidy funds (hereinafter referred to as subsidy funds) in Shandong Province, these rules are formulated.

Article 2 the term "subsidy funds" as mentioned in these rules refers to the subsidy funds given to Heze enterprises as the entrusting party or transferee for technology development and technology transfer activities with non-profit scientific research institutions and institutions of higher learning.

Article 3 The subsidy funds shall be listed from the provincial science and technology innovation and development funds and included in the annual budget of the provincial financial science and technology funds.

Article 4 These Rules shall apply to the technology transfer activities that meet the subsidy conditions carried out by enterprises in Heze City after January 1, 2019 (inclusive).

Chapter II Conditions and Standards for Subsidies

Article 5 An enterprise applying for subsidy funds shall meet the following conditions at the same time:

(I) enterprises registered in Heze City with independent legal personality;

(II) enterprises, as the entrusting party or transferee, have signed technology development contracts or technology transfer contracts with non-profit scientific research institutes and institutions of higher learning, which have been recognized and registered in the technology contracts and have actually paid the relevant technology transaction costs;

The place where the (III) realizes the transformation of scientific and technological achievements through technology transfer is in Heze City;

The source of (IV) technology is clear and there is no intellectual property right dispute.

Article 6 Subsidy funds shall be calculated in a piecewise cumulative manner according to the following standards:

The actual annual technical transaction volume paid by (I) enterprises is less than 10 million yuan (including 10 million yuan), and 15% of the actual transaction volume will be subsidized;

If the actual annual technical transaction volume paid by (II) enterprises exceeds 10 million yuan and is less than 50 million yuan (including 50 million yuan), 10% of the actual transaction volume will be subsidized;

If the actual annual technical transaction amount paid by the (III) enterprise exceeds 50 million yuan, 5% of the actual transaction amount shall be subsidized;

(IV) annual subsidy funds for a single enterprise shall not exceed 10 million yuan.

Chapter III Subsidy Procedures

Article 7 The Provincial Department of Science and Technology regularly issues notices. According to the notification requirements, enterprises submit electronic versions of application materials in the provincial science and technology cloud platform management system. The application materials include:

Application form for (I) subsidy funds;

(II) technology contracts;

(III) technology contract accreditation and registration certificate issued by the technology contract accreditation and registration agency;

(IV) technical transaction invoices and financial documents corresponding to the technical contract to prove the actual payment of technical transaction costs;

(V) other supporting materials to be submitted.

Article 8 the Science and Technology Bureau of Heze City shall conduct a preliminary examination of the application materials and be responsible for the authenticity, validity and completeness of the application materials.

Article 9 For enterprises that meet the subsidy conditions in the first instance, the Heze Municipal Science and Technology Bureau will publicize to the public for a period of 5 working days. After the publicity has no objection, it will formally recommend it to the Provincial Department of Science and Technology.

Article 10 The Provincial Department of Science and Technology shall review the application materials of the enterprises recommended by the Heze Municipal Science and Technology Bureau, and entrust a third party to carry out the review when necessary, and initially determine the subsidized enterprises and the amount of subsidies. Review results in the provincial science and technology department website to the public 7 working days.

Article 11 After the expiration of the publicity period and no objection, the Provincial Department of Science and Technology and the Provincial Department of Finance shall issue a subsidy fund plan and financial subsidy funds respectively in accordance with the procedures.

Chapter IV Administration of Subsidy Funds

Article 12 The subsidized enterprises shall continue to use the subsidy funds for scientific and technological research and development, achievement transformation and other related expenditures, effectively strengthen the use and management of the subsidy funds, consciously accept the supervision and inspection of the financial, auditing and other departments, and strictly implement financial rules and regulations and accounting Accounting methods, and strive to give full play to policy benefits.

Article 13 The Science and Technology Bureau of Heze City shall be responsible for the supervision and inspection of the use of subsidy funds.

Article 14 The Provincial Department of Science and Technology and the Provincial Department of Finance shall organize the performance evaluation of policy implementation every year, and the evaluation results shall be used as an important reference for subsequent budget arrangements or policy adjustments.

Article 15: If an enterprise has falsified or forged materials to defraud subsidy funds, it shall be recorded in the blacklist of integrity files, and relevant units and personnel shall be investigated in accordance with the relevant provisions of the Regulations on Penalties and Sanctions for Fiscal Illegal Acts (Order No. 427 of the State Council). Legal responsibility.

Chapter V Supplementary Provisions

Article 16 The subsidy funds shall be implemented on an annual basis, and one year shall be the implementation period of this year from the date when the Provincial Science and Technology Department issues the application notice.

Article 17 These Rules shall be interpreted by the Provincial Department of Science and Technology.

Article 18 These Rules shall come into force on October 1, 2019 and shall be valid until September 30, 2021.
