Shandong Provincial Administration for Market Regulation has issued the Implementation Plan for the Governance of Key Areas of Counterfeit and shoddy Products (2019-2021)

According to the official website of the Shandong Provincial Administration for Market Regulation, it has recently issued the "Implementation Plan for the Governance of Key Areas of Counterfeit and shoddy Goods (2019-2021)", which strictly investigates and deals with illegal activities of producing and selling counterfeit and shoddy goods, safeguards the vital interests of the people, and creates a good business environment.

方案针对“食品安全”、“农村市场”、“电商平台”、“认证领域”四大重点领域，提出了专项治理任务和措施。各级市场监管部门将坚持问题导向，发挥协同优势，强化技术支撑，推进社会共治，通过稳步有序开展专项治理，查办一批假冒伪劣大案要案，净化生产源头和流通网络，有效遏制假冒伪劣高发多发势头。争取到2021年，全省市场监管部门打击假冒伪劣的综合执法能力和监管现代化水平明显提升，工作机制更加完善，营商环境进一步优化，老百姓买得更加放心，用得更加放心，吃得更加放心。

The plan has identified four key areas for market supervision departments in the province to rectify in the past three years:

（1） Carry out special governance on food safety to ensure the safety of people's tongues

1. Carry out special governance on rural food safety. Focus on wholesale markets, rural food stores and other operators, and increase inspection efforts on daily consumer food, convenience food, leisure food, beverages, meat and meat products in the urban-rural fringe areas and rural markets. We will severely crack down on food safety violations such as counterfeit and shoddy food, "three no" food, expired food, "two excesses and one non" food, false labeling, and the use of expired or recycled raw materials to produce and process food. We will resolutely ban "black factories," "black dens," and "black workshops," and create a high-pressure crackdown situation. 2. Carry out a special food supervision campaign. Focusing on "one elderly and one young", we will increase the sampling intensity of health food and infant formula food, carry out special food inspection actions, and concentrate on investigating and punishing a number of illegal cases. Solidly promote the 100 day action plan to rectify the chaos in the "health" market and consolidate the effectiveness of the special rectification. Strengthen the system inspection of infant formula milk powder production enterprises, and complete at least one system inspection covering production enterprises within the jurisdiction in 2019. 3. Strengthen the special governance of campus food safety. The joint education department continues to carry out special inspections on food safety in schools and kindergartens. Strictly implement the "four inspections" system for food safety in school (kindergarten) canteens, and strengthen inspections of schools, kindergartens, and collective meal delivery units that mainly serve students. Promote the centralized and designated procurement of bulk commodities in school canteens, establish fast inspection laboratories, and strictly control the quality and safety of raw material procurement. 4. Promote the action of improving the quality and safety of catering. Implement a quantitative grading system for food safety in catering services. Conduct a special inspection on food safety in online catering services, and urge third-party platforms and online catering service providers to strictly comply with relevant regulations. Focusing on the processing and operation of noodle products in catering services, we will deploy a special campaign to address the issue of excessive aluminum content.

（2） Carry out special governance of rural markets to assist in the implementation of the rural revitalization strategy

1. Deepen the special rectification of the rural consumer market. Focusing on clothing, shoes, hats, small household appliances, children's toys, toiletries, building materials, and other products sold in rural markets, we will concentrate on carrying out special campaigns to crack down on counterfeit and shoddy products in rural areas and urban-rural fringe areas. Strictly crack down on counterfeit and shoddy goods, as well as "three no" products, and trace their origins. We must dig deep into the organizers and implementers of illegal activities, eradicate sales networks, and clean up production sources. 2. Deepen the special law enforcement of agricultural inputs products. In conjunction with relevant departments such as agriculture and rural areas, we will focus on key seasons, regions, and industries to carry out the "Anti Counterfeiting of Agricultural Materials to the Countryside" campaign. Focusing on products such as fertilizers, agricultural films, agricultural machinery and their accessories, we will carry out quality inspections of agricultural inputs and crack down severely on illegal activities of producing and selling counterfeit and inferior agricultural inputs that harm farmers. 3. Vigorously strengthen the governance of "counterfeit food" in rural areas. Starting from the source of production, distribution channels, and consumer terminals, comprehensively address the issue of "counterfeit food" in rural areas. Strengthen the supervision of food industry concentration areas, rural markets, small workshops, small shops, and certified enterprises and certified foods, with a focus on inspecting food products with the same or similar names, packaging, labeling, trademarks, etc., and urging producers and operators to strictly implement their main responsibilities for food safety. Strictly investigate and punish illegal activities such as confusion, false advertising, trademark infringement, etc., and carry out full chain investigations and punishments in accordance with the law for illegal producers and operators, as well as operators who provide trademark, advertising, certification, packaging and other services for them. 4. Strictly investigate and punish false and illegal advertisements. Intensify the review and supervision of advertisements in key areas related to the personal and property safety of the people, such as healthcare, pharmaceuticals, medical devices, food, health food, and financial investments.

（3） Carry out special governance of e-commerce platforms and purify the online market trading environment

1、不断加强网络交易平台监管。重点监管平台经营者对申请进入平台的平台内经营者形式审查义务、亮照亮标义务是否尽到，平台服务协议和交易规则是否侵犯平台内经营者和消费者的合法权益，推动网络身份认证、网店实名制，保障网络经营活动的规范性和可追溯性。2、严厉查处网络违法经营行为。强化对虚假宣传、虚假促销、刷单炒信、侵权假冒等违法行为的治理，净化网络市场环境。以网络销售的电子产品、半导体、汽车配件、儿童用品、老年用品等消费品为重点，加大监测和抽检力度，严厉打击电商领域侵犯知识产权和销售假冒伪劣商品违法行为。3、着力提升网络交易监管能力。提升运用技术手段发现违法行为、网上取证的能力，提高监测监管的针对性、精准性。制定电子数据取证程序规范，切实解决基层网络违法案件查处过程中取证难题。4、大力推进网络市场监管综合治理。推进线上线下一体化监管，加强《电子商务法》与《食品安全法》《产品质量法》《消费者权益保护法》《商标法》《广告法》等相关法律在执法中的衔接，探索建立风险监测、线索发现、网上抽查、取证分析、源头追溯、属地查处、信用公示、全流程可控监督机制。

（四）开展认证领域专项治理，有效维护认证信誉

1、开展认证实施机构和认证活动的专项监督检查。严厉打击未经批准擅自从事认证活动、超出批准范围从事认证活动等非法认证活动，以及虚假认证、买证卖证，增减遗漏认证程序的认证机构。2、开展检验检测机构监督检查，规范检验检测市场。以涉及安全、健康、环保等重点领域的食品农产品、建工建材、危化品罐车、生态环境、机动车等检验检测机构为重点，开展监督检查。严厉打击未经资质认定擅自向社会出具具有证明作用的检验数据、结果，以及超范围检验、不具备检验能力检验的违法违规行为，严厉打击篡改数据、出具虚假检测数据和结果等违法违规检验检测机构。3、加大执法力度，严厉查处未经CCC强制认证擅自出厂、销售、进口等各种无证违法行为。根据国家统一部署，针对电线电缆、小家电、儿童用品、电工产品、机动车、消防产品等重点领域产品，开展专项执法检查行动。

为保证治理工作的顺利实施，方案还围绕加强组织领导、完善投诉举报受理处置机制、建立执法办案协作机制、构建新型市场监管机制、加强宣传和舆论监督五个等方面做了具体部署。
