Interpretation of the Management Measures for the Access of Road Motor Vehicle Production Enterprises and Products
Recently, the Ministry of Industry and Information Technology announced the "Management Measures for the Access of Road Motor Vehicle Production Enterprises and Products" (Order No50(hereinafter referred to as the "Measures"). In order to better understand and implement the Measures, the head of the Policy and Regulation Department of the Ministry of Industry and Information Technology recently interpreted the Measures. It is reported that the Measures consist of seven chapters and 47 articles, with the main contents as follows:
（1） Simplified the types of enterprises and products. One is to simplify the originally overly segmented 19 categories of production enterprises and products into six major categories: passenger cars, trucks, buses, special-purpose vehicles, motorcycles, and trailers. After obtaining admission to a certain category, enterprises can produce products within that category without the need to apply for enterprise admission again, greatly reducing their burden. The second is to promote the management of vehicle product family, encourage enterprises to apply for product access for vehicle models of the same family according to the family, and significantly reduce the number of approved product models.
（2） Optimized the admission management process. One is to reduce the materials required for admission applications. The second is to implement record management. For enterprises that have already obtained access to change their legal representative, registered address, and other matters, as well as for vehicle products that have already obtained access to change their product parameters, the original re application announcement will be changed to record management.
（3） Established an open inspection and testing system. Firstly, it is clear that those who possess the corresponding legal qualifications can undertake the inspection work of vehicle product access management. Secondly, for those that have already been implemented3CCertified automotive parts can directly use the certification results without the need to submit inspection reports. Thirdly, pilot the self inspection of vehicle products in enterprise groups.
（4） A new system has been established to meet the needs of the development of new business models. One is to establish an evaluation system for new technologies, processes, and materials, laying the groundwork for innovative technology products such as intelligent connected vehicles and autonomous vehicles to enter the Announcement. Secondly, we will promote group management reform and simplify the admission review requirements for subsidiary enterprises of the group; Allow group member enterprises with the same production qualifications to engage in mutual outsourcing. Thirdly, in response to the further refinement of the division of labor in the industrial chain under the development trends of electrification, intelligence, and sharing in the automotive industry, R&D and design enterprises that meet the prescribed conditions are allowed to borrow the production capacity of production enterprises to apply for admission.
（5） Established a management system for entrusted production of trucks. One is to clarify that the production enterprises of road motor vehicles for trucks can independently complete the loading and production operations of flatbed, warehouse, box type, and dump vehicles, or entrust other loading and production enterprises to produce. The second is to clarify that the entrusted enterprise (truck enterprise) shall uniformly apply for road motor vehicle product access and bear the responsibility for product quality and production consistency.
（六）完善了监督检查措施。一是建立以随机抽查为重点的日常监督检查制度。二是建立特别公示制度，对已经取得车辆生产企业及产品准入，但不能维持正常生产经营的车辆生产企业，予以特别公示。三是建立信用记录制度，将道路机动车辆生产企业、检验检测机构失信行为记入信用档案。
（七）明确了法律责任。为了确保《办法》的各项制度落到实处，《办法》对未经准入擅自生产、销售、申请准入或备案时隐瞒有关情况、提供虚假材料、以出租、出借、买卖或者其他形式非法转让准入等行为，规定了相应的法律责任。
