Six ministries jointly issue a notice to carry out the clean-up and rectification of low-speed electric vehicles
Recommendation: The low-speed electric vehicle industry in China is developing rapidly, but it has also brought many problems. Now it has reached a point where it cannot be rectified without rectification. The joint issuance of a notice by six ministries and commissions to clean up and rectify low-speed electric vehicles is also the trend and the will of the people.
Recently, with the approval of the State Council, the Ministry of Industry and Information Technology, the National Development and Reform Commission, the Ministry of Science and Technology, the Ministry of Public Security, the Ministry of Transport, and the State Administration for Market Regulation issued the "Notice on Strengthening the Management of Low speed Electric Vehicles" (referred to as the "Notice"), requiring local people's governments of all provinces, autonomous regions, and municipalities directly under the central government to organize the clean-up and rectification of low-speed electric vehicles, strictly prohibit the addition of low-speed electric vehicle production capacity, and strengthen the standardized management of low-speed electric vehicles.
Low speed electric vehicles mainly refer to three wheeled or four-wheel electric motor vehicles with low driving speed, short driving range, and low technical level of key components such as batteries and motors, used for passenger or cargo transportation, including elderly commuting vehicles.
In recent years, the production and market scale of low-speed electric vehicles in China have expanded in a disorderly manner, with the number of production enterprises exceeding one hundred and the production and sales scale exceeding one million vehicles. The disorderly production and use of low-speed electric vehicles have brought a series of problems to society. Most low-speed electric vehicle products do not meet the requirements of current motor vehicle safety technical standards, and production enterprises do not have motor vehicle production qualifications. Vehicles are driven on the road without licenses, certificates, or insurance, which seriously violates relevant provisions of current laws and regulations and has a serious impact on road traffic safety and traffic order. According to relevant departmentsAccording to statistics in 2017, there were 830000 low-speed electric vehicle traffic accidents in China in the past five years, resulting in 18000 deaths and 186000 injuries. The number of accidents and deaths caused by low-speed electric vehicles has been increasing year by year, with an average annual growth rate of 23.3% and 30.9% in the past three years, respectively.
Therefore, more and more traffic participants are calling for strengthening the supervision of the production, sales, and use of low-speed electric vehicles from the source, safeguarding consumer rights and public transportation order, handling the relationship between traffic safety and convenient travel, increasing the crackdown on illegal production, sales, and use of such vehicles, and reducing safety hazards.
The Notice specifies the following three aspects of work to be carried out:
One is to carry out cleaning and rectification of low-speed electric vehicle production and sales enterprises. It will be implemented in three stages. The first stage is to understand the basic situation of low-speed electric vehicle production enterprises, laying a solid foundation for the subsequent stages of work. In the second stage, for enterprises found in the previous stage's investigation that use the "Announcement" license or special vehicle production license to produce and sell low-speed electric vehicle products beyond the scope, rectification should be carried out. For those without a business license, they should be banned and sealed up in accordance with the law. In the third stage, the provincial people's government should formulate a plan for the reduction, elimination, and transformation of low-speed electric vehicle production capacity in the region, develop and implement a special plan for local clean-up and rectification, and take comprehensive measures to clean up non compliant production enterprises and products in accordance with the law after relevant policies are released.
Secondly, it is strictly prohibited to increase the production capacity of low-speed electric vehicles. Require local governments to strictly implement relevant laws and regulations on the production and sales of motor vehicles, stop formulating and publishing policies to encourage the development of low-speed electric vehicles, stop formulating and publishing entry conditions for low-speed electric vehicles, stop approving or filing investment projects for low-speed electric vehicles, stop building new low-speed electric vehicle enterprises, expanding production plants and other infrastructure projects, and stop adding new low-speed electric vehicle models; Regions that have formulated and released relevant policies should immediately cease implementation, and projects under construction should be corrected immediately to ensure that the production capacity of low-speed electric vehicles does not increase.
三是建立长效监管机制。各省级人民政府要根据本地区具体情况制订在用低速电动车处置办法，研究设置一定时间的过渡期，通过置换、回购、鼓励报废等方式加速淘汰违规低速电动车在用产品。相关部门要加快研究制定后续相关政策措施，并建立部际联动、部地联动和联合督导机制，制定考核评估办法，对落实要求成效显著的地区和部门予以表彰，对工作不力的予以通报批评，对不作为的追责问责。
